Alternatively, now that we have class based shaping in 12.2T, couldn't we
also use this to offer more refined control?
eg wouldn't this also allow settting a maximum rate in times of congestion
and when congestion occurs avoid dropping traffic unless the shaping queue
fills?

Yes, you can do a bandwidth reservation and do policing at the
same time. The bandwidth command is used to configure a minimum
guarantee of bandwidth of the output queue when congestion occurs.
Unlike the low latency queue (the priority statement), the bandwidth
keyword does not have a built in policer. This means that while there
is a guaranteed minimum service, there is no enforced maximum service.
Using policing in conjunction with a bandwidth reservation allows you to
say class X is guaranteed Y amount of bandwidth, but can't go over Z
amount.
