Close, but I think you just reversed it. He was asking about never setting
the de bit for OSPF.

access-list 101 deny ospf any any
access-list 101 permit ip any any

frame de-list 1 protocol ip list 101

Correct me if I am wrong QOS gurus, but I believe you can do this like.
Access-list 101 permit ospf any any Access-list 101 deny ip any any
Frame-relay de list 1 protocol ip list 101 Interface %frame-interface%
Frame-relay de-group 1 %dlci if needed%
