If one have to work within the limits of the question, my understanding is CAR have to be used. Agreed, CAR can not be used to prioritize traffic on this router, but one can use it to mark a traffic with a higher precedence/DSCP value on this router and the next or subsequent routers can act on those markings to prioritze the traffic.

If a task mentioned that one should use CAR, the last thing that I will be thinking about is priority queuing. As you said, the CCIE lab is not a best practice lab. It is important that questions like these be clearified with the proctor.

  First I don't see what CAR has to do with giving max priority. Second, if no marking value is supplied, I'd look for a way to do this without a marking requirement. One can use legacy priority queueing and assign all TCP traffic to the highest priority queue.
