I would read this a little differently.
First I don't see what CAR has to do with giving max priority. Second, if no
marking value is supplied, I'd look for a way to do this without a marking
requirement. One can use legacy priority queueing and assign all TCP traffic
to the highest priority queue.

This is probably not the way you'd want to do things in the real world these
days, but then again that's not relevant to CCIE questions :)
