The DSCP value broken into 2 parts. One of this part Ip precedence (3 bits
length), and other Drop precedense (3 bit). DSCP consist inside DS byte.
Don't be confused with terminology - ToS and DS bytes is the same, occupyiing
the same location insite IP header.

But may be this question direct you to check Urgent field in the TCP header ?
lake(config)#access-list 101 permit tcp any any urg
