As long as I know on traffic shaping implementation (because on the
question is consider about CIR or MINCIR traffic) BE traffic also
discard eligible...correct me if I am wrong

You can set the DE bit on the CE side (assuming that is a Cisco router)
by
DE-list, a set command in MQC or as an exceed action in policing.
The frame-relay switches within the provide network are not Cisco
routers
and the configuration will be dependant upon what devices they are :)
Not all frame relay providers use the DE bit for congestion management.
