The CCIE certification is always retained by the individual who earned it. However, for the purposes of the Cisco partner programs a previous employer may be able to retain the use of your certification for partner status qualification purposes, only.
Unfortunately, CCIE's are less desireable to some Cisco Partners if their certs are not portable for partner status reasons. This should not discourage anyone from getting their CCIE. Cisco partners are some of the worst places a CCIE could work anyway.
