This is a very real problem. At least one commercial provider of study
materials who has participated here made the choice to not sit the lab for
this very reason. By not attempting the lab, he is not bound by the terms
of the NDA. In my opinion this is a wise choice for anyone considering
going into that business. It might detract from his salability to some
extent as he won't have a number but it will help keep the hordes of hungry
lawyers away.
A commercial prep outfit is high-profile with regards to this type of
thing. Also, there's a certain time lag between writing the scenario
or prep material, testing it, publishing it, and selling it. Not a
big lag with electronic media, but a lag.
Far more troublesome in terms of "leakage" in my opinion are the
questions in this and similar forums of "How do I do 'X'" where 'X' is
something that's lifted from the exam that the guy took yesterday.
Then half a dozen others with recent numbers follow up with posts
screaming "NDA! NDA!", which serves to validate that the question is
indeed on recent exams.
