MPLS-TE bandwidth allocation and policing

Hello,
I would like to hear your recommendation in following scenario:

Lets say we have a few PE Internet routers running different bandwidth
links between them. The demand is to setup MPLS TE between those PEs based
on free bandwidth available. If customer buys 300mb of bandwidth, but we
want to load his traffic by 50m through one tunnel, and 250m on second
 main MPLS-TE and also police to this bandwidth(I suppose the only way is
by MPLS exp bit)
If there is no enough bandwidth for particular tunnel, give 300mb through
one main link.
