frames not marked cos

'morning everybody

easy question.. I don't see where I'm wrong but should be easy (at least
for you!)
(first QoS labs on Catalysts)

lab: R1---SW1---R5

R1 is on vlan 5 (10.0.0.1)
R5 has a trunk port to SW1 and an ip address on vlan 5 (10.0.0.5)

SW1 has mls qos enabled
SW1 trusts cos on the interface to R5
R5 has a service-policy out where for default-class there is a set cos4
R1 has an access-list permit icmp any any cos 4

I can ping from R5 to R1.
Packets get to R1 w/o cos4.

I'm doing this with real devices of course.

show mls qos inter to R5 statistics shows only default cos

what am I missing?
