It is hard to follow the exact request and answer in this email. It really depends on the setup of the nexus 5ks. If you are using vPC's the nexus switches will not forward a layer2 packet destined for the FHRP gateway if the packet originates from a downstream host on a vPC link. HSRP in the Nexus switches was tweaked so that the standby HSRP switch will forward the packet, although the packet was sent to the Mac address of the active HSRP switch. This however depends on which side the packet comes into the 5ks at if you are using vPC spanning tree towards your vPC downstream switch is turned off and all your downstream ports forward traffic.
I would have to see a diagram of what Imran was talking about to really see if the scenario would work. Do your 5ks have the routing module? Are your 5ks your distribution block, or do you have a upstream layer3.
