Here's another point of view:

The network is (should be ?) there to bring a service (L3) to connect
apps (L7) that want to communicate. Every packet that is there to
make the service possible but that is not carrying app data could
be consider control plane (overhead).

That would put ICMP in thr control bag. It would also put the 3 way
handshake of TCP there... I can live with that :)
