Policing Question: still violating traffic.

Dear GS,
I need to clear out a Policing Confusion:

I have set my fastethernet interface to police traffic rate at 10 Mbps and
with respect to that i have set a Bc of 312500 Bytes (2.5 Mb per 250ms). For
a test i have set the Be to 0.
The Packets that Exceed the Bc at a given interval should be counted into
Exceed Counters. But i am seeing some Violated Packets on my interface.

Just need to clear that at a given default 250ms interval (Tc) if enough
tokens (Bc + Be) are not available for a packet, will it still be counted as
Violated?

And I am recieving some CRC Errors also on the interface, is it related to
the Policing that i have configured.
The Interface is a busy one.
