Out-of-contract Frame Relay Traffic DE settings

Hello all,

here is another question that gives me a major headache: The requirement is
to set the Frame Relay DE bit on a 128K link, ensuring that Tc is 125ms. Out
of contract traffic should have the DE bit set (DE1) and in contract traffic
should not have the DE bit set (DE0). I am thinking to configure a class,
found this example on CCO:

policy-map set-DE
  class class-default
   police 128000 24000 conform-action
   transmit exceed-action set-frde-transmit
   violate-action set-frde-transmit
!
map-class frame-relay pvc100
  service-policy input set-DE

I am confused about the Be, do I have to specify the Be in order to have
traffic that exceeds the Bc get the DE bit set to 1 ? I think I am missing
the point here, appreciate your help.
