About if CEF is mandatory not only with NBAR, I think that CEF is
requirement if you are using CBWFQ:

RESTRICTIONS
The following restrictions apply to the Class-Based Packet Marking
feature:
* It can mark only packets traveling on CEF switching paths. In order
to use the Class-Based Packet Marking feature, you must configure CEF
on both the interface receiving the packet and the interface sending
the packet.
PREREQUISITES
CEF must be configured on the interface before the Class-Based Packet
Marking feature can be used.
So it doesn't apply only to NBAR, it applies also to CBWFQ. Please,
correct me if i4m wrong.
P.D.: and CEF is also mandatory for QoS Policy Propagation via BGP
