tcp setup bgp peer

Situation: 2 router setup a bgp adjacency (ibgp or ebgp).
Both router try to start the tcp session first. One will win and I think the
other tcp session die.
How I can controll this which will win?

These situation is interessting, when you form a peering and you have
a AS mismatch and you want force your "foreign" router sent the
(wrong)AS-number, instead
you sent your AS and the foreign will give you only the answer that there is
a AS mismatch.

Check this: R8(AS11=000B) and R7(AS7)

In this case R7 detect the AS-mismatch and send a message.
How I could force R8 to do that?
