I would be really surprised if Cisco went after someone for upgraded a
SMI version to EMI version when they were using it in a lab. If Cisco
started going after people upgrading routers and switches for their labs
and forced them to buy the actual software licenses it would quickly put
the CCIE out of reach for a lot "more" people.

Lastly since people that become certified by Cisco (CCNA, CCNP, CCIE,
etc) essentially become a "sales force" out there in the market for
Cisco why would they want to stop us from learning all they can about
their products?

EMI Code is a license thing... you don't want to buy one switch and
install
code like that... It's not legal.

I asked the very same question and here's the scoop I've heard...

1. The 3550 will be migrated into the lab exam between October 1st and
November 4th.

2. If you have a lab exam between those dates, you could get a cat5K or
two 3550s on your pod. It's a toss-up.

3. The 3550 on your pod will be loaded with EMI code. This provides
layer 3 capabilities.

4. The 3550s are running in the $2200 - $2400 price range with SMI
code. If you have a service contract with Cisco, you can download the
EMI code. If you don't have a service contract, the EMI code is an
additional $2000.
