max-path will work in ebgp if you have multiple peers in the same remote AS.
this works:
router bgp 1
neigh 1.1.1.1 remote-as 2
neighbor 2.2.2.2 remote-as 2
max-path 2
this doesn't:
router bgp 1
neigh 1.1.1.1 remote-as 2
neighbor 2.2.2.2 remote-as 3
max-path 2
